The Camper Imperium brand is represented by Ci Performance KlG. Further information on the commercial register entry or authorized representation can be found in the imprint.

The contractual partner for service, trade and production services is Ci Performance KlG. Unless otherwise agreed, these general terms and conditions apply to all business sectors.

2. scope of application

The Camper Empire reserves the right to change the General Terms and Conditions (hereinafter referred to as "GTC") and their appendices. The contents of the annexes to the GTC are part of the GTC. The version of the GTC and their appendices valid at the time of the order, agreement or conclusion of the contract shall be authoritative and cannot be changed unilaterally. The GTC are addressed to natural customers domiciled in Switzerland and apply to all orders placed (in particular via the online shop), services offered and other contracts concluded. Terms and conditions of the customer that conflict with or deviate from these GTC shall not apply, even if Camper Imperium does not separately object to terms and conditions of the customer that deviate from these GTC.

All agreements between the Camper Imperium and the customer must be made in writing (e.g. letter or email). The language available for the conclusion of the contract is exclusively German, even if translation aids are provided in other languages. The GTC and their appendices apply to all legal transactions, namely orders, bookings and the provision of services, which are concluded online or via email or in person via the websites of www.camperimperium.com, www.camperimperium.ch, www.campermanufaktur.ch, www.pandoraalarm.ch and their subdomains (e.g. www.camperimperium.com/onlineshop/).

3 Applicable law

Amsteg (UR) is the place of jurisdiction for all disputes arising directly or indirectly from a contractual or agreement relationship. The legal relationship is subject to Swiss law. The Camper Imperium is furthermore entitled to sue its claims against third parties at their place of residence.

In the case of concluded rental contracts, the statutory provisions on the package travel contract pursuant to SR 944.3 shall not apply to the contractual relationship either directly or mutatis mutandis. The hiring party arranges his journey himself and uses the vehicle on his own responsibility. The rental contract is limited to the agreed duration. The tacit extension of the rental relationship for an indefinite period due to continued use pursuant to Art. 266 para. 2 CO is excluded.

4. data protection

Data protection is a matter of trust. That is why we follow the European General Data Protection Regulation (hereinafter "DGSVO"), which has established itself internationally as a benchmark for strong, effective data protection. Further information on the processing of personal data can be found in the data protection declaration at www.camperimperium.com/datenschutz/ to read.

The data protection declaration is an integral part of these GTCs. By accepting these GTCs, the customer also agrees to the privacy policy. The customer agrees that the Camper Imperium may store his personal data and use it without separate consent for the purpose of processing and fulfilling the contractual relationship or for information purposes.

5. offer

The presentation of rental vehicles, accessories, extras, products and services on the website and in the Camper Imperium online shop does not constitute a legally binding offer. The offer is valid while it is visible on the website and/or while stocks last. Prices and product ranges are subject to change at any time. The images shown on the website and all information on the products are for illustration purposes and are not binding. The specific details from the rental contract, purchase contracts and any contracts for separate services are authoritative. The Camper Empire is free to refuse orders and service requests in whole or in part without stating reasons. In this case the customer will be informed and any payments already made will be refunded. Further claims due to delay in delivery and service provision, failure of delivery or non-fulfilment of a service are excluded.

All prices quoted on our website are in Swiss francs (CHF) and include value added tax (VAT) and other charges, unless otherwise stated. The price on the website at the time of the order in the online shop or vehicle booking is decisive. Services are offered on a non-binding basis by Camper Imperium on the basis of the project agreement or customer request. This is an indicative offer. Invoices will be issued after the service has been rendered for the actual service rendered including any additional expenses. We reserve the right to adjust prices at any time without prior notice due to changes in market conditions, inflation or exchange rate adjustments.

Discounts are not cumulative. Discount coupons within the scope of a discount and special promotion expire according to the promotion period stated and communicated on the website and in the newsletter and can only be redeemed during this limited period.

The following payment methods and payment service providers are generally available on the website: Bank transfer, QR deposit slip or Twint. In the shop, payment can also be made via Twint or in cash. Further information on the payment methods must be obtained by the customer from the respective banking group used. We reserve the right to change the payment methods and service providers offered at any time.

Payments must be made in Swiss francs. Purchase in the online shop or the provision of a service on account is not provided for. The Camper Empire reserves the right to deviate from this at its own discretion. In the event of late payment, we are entitled to cancel the vehicle booking, to refuse to hand over the vehicle provided or to refrain from dispatching the goods, without the need to set a separate deadline. If payment is not made within the due date, the customer shall be in default. In this case the Camper Imperium reserves the right to charge the customer a reminder fee in addition to the invoice amount. In addition to the payment of the invoice amount, the customer shall also be obliged to reimburse all costs arising from the delay in payment. The cancellation and withdrawal conditions of these GTC apply accordingly.

In accordance with legal requirements, invoices shall be issued exclusively in electronic form and sent to the e-mail address provided. The customer shall bear the additional costs (e.g. postage) incurred for the delivery of an invoice in paper form.

The Camper Empire always endeavours to keep the data published and communicated in the context of a consultation as well as information in the online shop, the website and up-to-date and correct.

Due to production/delivery bottlenecks and sales via other channels, delivery backlogs may occur. Therefore, all information on availability and delivery times in the online shop or offers are without guarantee and may change at any time.

The Camper Imperium also accepts no responsibility for the accuracy or currency of information and content provided by external manufacturers or on the part of the Camper Imperium, even if this has been carefully researched. In particular, this applies to articles published in the Camper Imperium magazine which have been written on the basis of our expertise, experience and own assessments or information which has been researched for the purpose of publication. The Camper Imperium also advises its customers on products, gives tips for DIY builders and makes recommendations for customer projects. All advice is given to the best of our knowledge and belief, but this cannot be assumed by the customer and, above all, no liability is accepted.

Appendix 1 to the GTC: Online shop

1. scope of application

The Camper Empire reserves the right to change the appendix to the General Terms and Conditions. The version of the GTC in force at the time of the order, agreement or conclusion of the contract as well as its appendices, which cannot be changed unilaterally, shall be authoritative in each case. The contents of the annexes to the GTC are part of the GTC.

 

2 Conclusion of contract

The illustrations, descriptions and prices of products on the website www.camperimperium.com and alt/sub domains are non-binding and may be changed at any time. They do not constitute an offer of contract. By ordering a product in the online shop, by telephone or by email or in the case of a sales enquiry after consultation between the Camper Imperium and the customer, the customer makes a binding offer to purchase. The prerequisite for a valid purchase contract is the complete and truthful completion of the order form provided in the online shop or the data communicated via other channels (email, Whatsapp, etc.) regarding the scope of the order and the person as well as the acceptance of these GTC and their appendices. The Camper Imperium confirms the receipt of the order with an e.g. automatically generated order confirmation by email. This merely indicates to the customer that the order has been received and that the purchase contract has been concluded subject to the delivery option and the correct price information. A purchase contract is concluded through the ordering process and acceptance by the Camper Imperium.

 

3 Delivery & Shipping

The customer's delivery address must be in Switzerland and the Principality of Lichtenstein. Deliveries abroad require a separate agreement with Camper Imperium. The shipping conditions generally only apply within Switzerland and the Principality of Lichtenstein. In the case of deliveries abroad, the customer shall bear the taxes and customs duties incurred as well as the parcel fees and any further expenses for administration. The delivery costs depend on the quantity of products ordered. The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item in the shopping basket and on the invoice.

Products marked as "available" in the online shop are normally prepared for delivery within 1 to 2 working days after receipt of the order or are available for collection at the collection address (Grund 77, 6474 Amsteg, Switzerland). Collections can also be made at weekends by arrangement.

If a product is out of stock or incorrectly marked as "available", customers will be notified by e-mail or telephone and a new provisional delivery date will be agreed. The Camper Imperium will endeavour to make a prompt subsequent delivery and will dispatch any backordered goods without additional shipping costs. If the Camper Imperium is unable to confirm a binding delivery date within 30 calendar days of receipt of the order (with the exception of customised products or ready-made goods, see below), the customer has the right to withdraw from the purchase contract. If an item can no longer be procured or manufactured, the Camper Empire may withdraw from the contract and must refund the customer in full for any payments already made for the product in question. There are no further claims against the Camper Imperium.

If the customer is not present at the time of delivery, the delivery service will leave a collection invitation in the letterbox, unless otherwise agreed between the delivery service and the customer. The customer must collect the delivery from the post office noted. Any order not collected within the specified time limits cannot be held or refunded. The customer is solely responsible for orders collected late and any rights for defects are excluded for this. The customer assumes responsibility for the products delivered, even if they were not received directly by the customer. If additional shipping costs are incurred due to an incorrect delivery address or incorrect address data, these costs shall be borne entirely by the customer. The Camper Empire reserves the right to charge a handling fee of 15 %, but no less than 40 CHF, for the additional costs incurred in the event of a reversal of the order. Fees for third-party providers or payment service providers incurred as part of the order will not be refunded.

Customised products or ready-made goods are those products that are not listed in the Camper Imperium online shop or may require a procurement period of more than 30 calendar days. Delivery periods and dates for this type of order are agreed between the Camper Imperium and the customer in writing or verbally.

 

4. retention of title, notice of defects and transfer of risk

The goods delivered or handed over to the customer remain the property of Camper Imperium until the purchase price has been paid in full.

 

If products are delivered with obvious damage to the packaging or the contents, the customer must complain about this immediately to the delivery service and refuse acceptance, without prejudice to their rights in respect of defects. The customer shall be obliged to obtain a damage confirmation report from the delivery carrier. All transport damage must also be reported immediately to the Camper Imperium.

 

Furthermore, it is the customer's responsibility to inspect the ordered products immediately upon receipt. For any defects or deviations from the order, the Camper Imperium must be notified by e-mail info@camperimperium.com on the day of delivery, otherwise the goods will be deemed approved and all warranty rights will be excluded. The Camper Imperium reserves the right to demand proof of the defect.

 

The risk of accidental deterioration or loss of the ordered goods shall pass to the buyer as soon as the consignment has been handed over to the person carrying out the transport. Any assumption of transport costs by the Camper Imperium agreed in individual cases shall not affect the transfer of risk.

 

5. right of withdrawal and cancellation

A return or exchange of purchased items as well as changes or cancellations of confirmed orders are not provided for, but are possible at the discretion and in goodwill of the Camper Imperium. In the event of a cancellation accepted by Camper Imperium, the goods must be returned to Camper Imperium GmbH, Grund 77, 6474 Amsteg at the customer's expense. Payments made will be refunded within 14 days less a handling fee of 15 %, but at least 40 CHF. In the event of a loss in value of the goods, the buyer shall only be responsible for this if it results from a use of the same which exceeds the examination of the properties, condition or function of the goods. In the case of originally packaged or sealed goods, damage to the packaging or breaking of the seal constitutes a loss of value.

 

6. guarantee and warranty conditions

The Camper Imperium manufactures goods itself or offers goods from other manufacturers. The Camper Imperium has no influence on the durability and functionality of the products or the warranty of other manufacturers. The warranty claim for products from other manufacturers against the Camper Imperium is therefore excluded. However, the manufacturer's warranty information shall apply insofar as it is valid in Switzerland. In all other respects, the Swiss statutory warranty provisions pursuant to Art. 197 ff. OR.

 

There is no warranty claim for damage due to improper use, incompatible use or defects caused by external influences. These could be, for example, damage caused by the elements and moisture, damage caused by falling or impact, the effects of force or damage caused by modifications. Wear parts such as batteries, cables, illuminants, auxiliary materials and lubricants, fuses, etc. are excluded from any warranty. In the event of a warranty claim, the Camper Imperium may, at its own discretion, carry out a repair free of charge, replace the goods or provide a full or partial credit note of the sales price.

 

7 Liability and exclusion of liability

The Camper Imperium is only liable for warranty claims which are listed under point 6. Any further liability is excluded, in particular liability for damage that has not occurred to the products themselves. Under no circumstances will liability be accepted for slight negligence, indirect and consequential damage, loss of profit or unrealised savings. Liability is further excluded for damage resulting from delays in delivery, from improper use of the product, from the use of incompatible spare parts or accessories, from neglected or improper maintenance and repair or in the event of force majeure. Claims for damages arising from impossibility of performance, from breach of contract, from culpa in contrahendo and from tort are excluded against us as well as against our vicarious agents or persons employed in the performance of our obligations, except in the case of intentional or grossly negligent conduct.

A purchase contract is concluded through the ordering process and acceptance by the Camper Imperium.

3 Delivery & Shipping The customer's delivery address must be in Switzerland and the Principality of Lichtenstein. Deliveries abroad require a separate agreement with Camper Imperium. The shipping conditions generally only apply within Switzerland and the Principality of Lichtenstein. In the case of deliveries abroad, the customer shall bear the taxes and customs duties incurred as well as the parcel fees and any further expenses for administration. The delivery costs depend on the quantity of products ordered. The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item in the shopping basket and on the invoice.

Products marked as "available" or "in stock" in the online shop are normally prepared for delivery within 1 to 2 working days from receipt of the order or are available for collection at the collection address (Grund 77, 6474 Amsteg, Switzerland). Collections can also be made at weekends by arrangement.

If a product is not in stock or wrongly identified as a "available" or "in stock marked, this will be communicated to the customers by e-mail or telephone and a new provisional delivery date will be agreed. The Camper Imperium will endeavour to make a prompt subsequent delivery and will dispatch any backordered goods without additional shipping costs. If the Camper Imperium is unable to confirm a binding delivery date within 30 calendar days of receipt of the order (with the exception of customised products or ready-made goods, see below), the customer has the right to withdraw from the purchase contract. If an item can no longer be procured or manufactured, the Camper Empire may withdraw from the contract and must refund the customer in full for any payments already made for the product in question. There are no further claims against the Camper Imperium.

The customer must collect the delivery from the post office noted. Any order not collected within the specified time limits cannot be held or refunded. The customer assumes responsibility for the products delivered, even if they were not received directly by the customer. If additional shipping costs are incurred due to an incorrect delivery address or incorrect address data, these costs shall be borne entirely by the customer. 4. retention of title, notice of defects and transfer of risk The goods delivered or handed over to the customer remain the property of Camper Imperium until the purchase price has been paid in full.If products are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the delivery service and refuse to accept them, without prejudice to their rights in respect of defects. The customer shall be obliged to obtain a damage confirmation report from the delivery carrier. All transport damage must also be reported immediately to the Camper Imperium. Furthermore, it is the customer's responsibility to inspect the ordered products immediately upon receipt. For any defects or deviations from the order, the Camper Imperium must be notified by e-mail info@camperimperium.com on the day of delivery, otherwise the goods will be deemed approved and all warranty rights will be excluded. The Camper Imperium reserves the right to demand proof of the defect. The risk of accidental deterioration or loss of the ordered goods shall pass to the buyer as soon as the consignment has been handed over to the person carrying out the transport. Any assumption of transport costs by the Camper Imperium agreed in individual cases shall not affect the transfer of risk.

The Camper Imperium has no influence on the durability and functionality of the products or the warranty of other manufacturers. 1. scope of application

The order of services or production services offered by us is understood as an invitation to submit an offer by the customer. The Camper Empire is free to refuse orders and service requests in whole or in part without giving reasons. A contract is only concluded by an offer on our part and subsequent placing of an order by the customer. The conclusion of the contract is effected by concurring declarations of intent, i.e. when there is agreement as to what one wishes to agree with the other. These declarations of intent do not have to be made expressly and certainly not in writing, but above all by implied conduct. If the customer provides his own vehicle for individual conversion, a binding offer by us will only be made after the customer has inspected it. For details of the respective scope of services (vehicle, conversion measures, equipment criteria, etc.), reference is made to the product description selected and specified in the indicative offer and additional documents (e.g. email). All offers are subject to price changes.

 

The offer expires if it is not accepted in writing (also by e-mail) within two weeks of receipt or if the request for a down payment by the customer is not complied with. The content of written order confirmations shall be authoritative unless the customer objects immediately. A right of withdrawal does not exist, but may be granted by Camper Imperium as a gesture of goodwill. Any deviation, supplement or ancillary agreement must be in writing in order to be valid.

 

The Camper Imperium reserves the property rights and copyrights for illustrations, drawings, calculations, 3D models and other documents. This applies in particular to written documents that are designated as confidential. The express written consent of the Camper Imperium is required before they can be passed on to third parties.

 

3. project implementation

The basic procedure of a project is divided into the following steps: Enquiry by the customer, consultation by the Camper Empire, agreement on the project details (if necessary, procurement of base vehicles), preparation of a non-binding offer by the Camper Empire, binding order placement by the customer, project implementation at the business location of the Camper Empire, handover to the customer at the business location (unless otherwise agreed). The customer agrees that any modifications to the vehicle that are necessary for the removal/conversion or the agreed service are deemed to be contractually agreed. These are, for example, interventions in the existing electrical system, laying of new cables, or changes to the bodywork (cutting, drilling, etc.). The Camper Empire declares that it will carry out all work in accordance with the recognised rules of technology. If an approval of the technical modification by the traffic authority is legally provided for, this will be carried out by the Camper Imperium after agreement. If the customer decides against the MOT service, any registration guarantee that may have been issued shall expire.

 

Installations and conversions are made individually according to the customer's wishes to suit the vehicle and cannot be used for other vehicles.

 

Change requests that occur after the start of project fulfilment and cause additional costs are to be borne by the client.

4. customer requirements

The customer undertakes to make his vehicle available for the agreed project on time at the specified date. If the vehicle is not handed over punctually at the agreed time, Camper Imperium may claim damages. Should the order not be able to be carried out on time, costs amounting to a flat rate of 1000 CHF may be claimed per day on which we are unable to bring forward another order.

 

Claims or rights of the customer against the Camper Imperium may not be assigned or pledged without the customer's consent, unless the customer has proven a legitimate interest in the assignment or pledge.

 

5. delivery and performance period

The provision of our service shall take place depending on the scope of services and within an agreed period of time. The date stated in the offer is non-binding. Binding deadlines will be confirmed by us separately. Deviations from the delivery period may arise in particular due to delays in the procurement of vehicles and installation parts by our suppliers. If non-compliance with the performance of the service is impossible or excessively difficult due to force majeure or other events for which we are not responsible (e.g. influences of natural events, illness or death), the performance deadlines shall be extended accordingly and we shall be released from the obligation to perform for the duration of the hindrance.

The Camper Empire reserves the right to withdraw from the contract if obstacles persist for an unforeseeable period of time. The customer will be informed immediately of any delays and all services received will be refunded. The customer cannot assert rights due to delay for the aforementioned reasons.

The customer shall be fully responsible for any delay in delivery due to the fault of the customer or a third party commissioned by the customer.

The transfer of risk takes place with the handover of the vehicle or project result. If the customer is in default of delivery for reasons for which he is responsible or if he requests a later handover, the risk shall pass to him from the beginning of the delay.

6. right of withdrawal and cancellation

The customer has the right to terminate the contract at any time. He is then still obliged to pay the agreed remuneration minus our saved expenses. In addition, the contract may be terminated by either party for good cause. In this case, the remuneration shall be due which has accrued for the work performed by us up to that point.

The delivered service or the conversion carried out in the customer's vehicle shall remain the property of Camper Imperium until the purchase price has been paid in full. The customer shall be obliged to treat the goods subject to retention of title with care. If the customer does not comply with a request for payment, the Camper Imperium reserves the right of retention. In this case, the vehicle shall only be handed over after the invoice has been paid in full.

8. notice of defects and warranty

The customer and the Camper Imperium agree on the materials of a service and production performance, especially if these involve the processing of natural materials, e.g. wood. The Camper Imperium expressly points out that although real wood is not considered a common material for vehicle construction, it can be used if the care instructions handed out or communicated are observed. When using real wood, deformation or changes in the colour of the wood can always occur. This is not a quality defect, which requires a warranty claim. The customer undertakes to report such anomalies to Camper Imperium immediately so that appropriate measures can be taken.

 

Claims for defects must be reported to the Camper Imperium at the time of or at the latest within 7 days of taking over the vehicle. The Camper Imperium shall, at its own discretion, provide a warranty for defects by rectifying the defect or producing a new vehicle. If the rectification of defects fails, the customer may demand a price reduction or cancellation of the contract. This also applies if we seriously and finally refuse to rectify the defect. The customer shall not be entitled to withdraw from the contract if the defect or breach of duty is insignificant.
